AG Ellison should refuse to enforce the federal hemp products ban

You’ve probably seen that a provision in the Shutdown Bill bans a lot of hemp-derived THC edibles. That law criminalizes anything over 0.4 milligrams of THC per serving. The current limit in Minnesota is 5 mg.

Minnesota AG Keith Ellison signed a letter asking for a federal law limiting the legal potency of THC products. He’s since said that he didn’t mean for that to affect anything that is currently allowed under Minnesota law.

This would have happened no matter what Ellison, who is feared and hated by the right wing, did. But a good way for him to make up for it anyway would be to make it clear that Minnesota won’t enforce the new federal law where it conflicts with Minnesota law. It would also set a good example for state AGs elsewhere.

The precedent, in practical reality, for that is obvious. Marijuana is still illegal under federal law. The feds simply aren’t trying to enforce that in states that have legalized or decriminalized weed. Even the Trumpers don’t seem to be trying to change that, perhaps in part because they know that plenty of their strongest supporters like to just sit around and smoke dope and wallow in incel grievance politics all the time.

Heck, Trump himself would probably want to have someone check out potential profiteering from Trump-branded ultrapotent THC gummies. Which would be worth it if he started spacing out on those, day in and day out, instead of massively screwing up everything he touches as he’s doing now. And as right-wingers do in general.
